1. Introduction and Acceptance of Terms

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“Customer,” “you,” or “your”) and CAR BUY CHINA, its affiliates, and subsidiaries (“we,” “us,” “our,” or the “Company”), governing your access to and use of our website (carbuy.com.co), services, communications, and any related transactions.

By accessing our website, submitting an inquiry, requesting a quotation, or engaging in any business activity with us, you expressly acknowledge that you have read, understood, and agreed to be bound by these Terms in their entirety. If you do not agree with any part of these Terms, you must immediately discontinue use of our services.

These Terms are designed to provide clarity, fairness, and mutual understanding for serious international buyers, including dealers, distributors, fleet operators, government agencies, and corporate clients.

2. Scope of Our Services

CAR BUY CHINA is a professional exporter of brand-new vehicles manufactured in the People’s Republic of China. We facilitate the end-to-end export process for international buyers, including:

  • Provision of factory-direct quotations for new electric, hybrid, and gasoline vehicles;
  • Coordination of pre-shipment inspections at Chinese ports;
  • Preparation of complete, destination-specific export documentation;
  • Arrangement of global shipping and logistics;
  • Provision of after-sales technical support and warranty claim facilitation.

We act as an export execution partner, not as a broker, agent, or legal representative. We do not provide legal, financial, customs brokerage, or import compliance advice for your jurisdiction. You are solely responsible for ensuring your import activities comply with all applicable laws in your country.

3. Eligibility and Lawful Use

You represent and warrant that:

  • You are at least 18 years of age or the legal age of majority in your jurisdiction;
  • You are acting on behalf of a legally registered business entity (if B2B);
  • Your use of our services is for lawful commercial purposes only;
  • You will not use our platform for fraudulent, speculative, or unauthorized resale activities.

We reserve the right to refuse service to any party without explanation, particularly if we suspect misuse, non-compliance, or reputational risk.

4. No Guarantee or Binding Offer

All information on our website including vehicle specifications, pricing, availability, and delivery timelines is provided for informational purposes only and constitutes an invitation to treat, not a binding offer. A binding contract is formed only upon our issuance of a formal Proforma Invoice or Export Agreement, signed by both parties.

Vehicle availability is subject to manufacturer production schedules and port logistics. We reserve the right to cancel or modify orders due to force majeure, regulatory changes, or supply chain disruptions beyond our control.

5. Due Diligence and Buyer Responsibility

You acknowledge that international vehicle importation carries inherent risks, including but not limited to:

  • Regulatory changes in your destination country;
  • Customs delays or rejections;
  • Currency fluctuations;
  • Port handling fees and local taxes.

You are solely responsible for:

  • Verifying import eligibility, homologation, and registration requirements in your jurisdiction;
  • Engaging qualified local customs brokers, advocates, or agents;
  • Confirming final vehicle specifications before order confirmation.

We strongly recommend conducting independent due diligence before placing any order.

6. Compliance with Laws

You agree to comply with all applicable international, national, and local laws, including:

  • Anti-bribery and anti-corruption statutes (e.g., FCPA, UK Bribery Act);
  • Sanctions and export control regulations (e.g., UN, EU, U.S. OFAC);
  • Local vehicle safety, emissions, and conformity standards.

You shall not use our services to export vehicles to embargoed countries, restricted entities, or for military or dual-use purposes without prior written authorization.

As of January 1, 2026, China enforces a 180-day rule: vehicles registered in China for less than 180 days cannot be exported as “used” without a manufacturer-issued Certificate of After-Sales Service

7. Intellectual Property

All content on our website including text, graphics, logos, images, and software—is the exclusive property of CAR BUY CHINA or its licensors and is protected under international copyright and trademark laws. You may not reproduce, distribute, or create derivative works without our express written permission.

8. Limitation of Liability

To the fullest extent permitted by law, CAR BUY CHINA shall not be liable for any indirect, incidental, consequential, or punitive damages arising from:

  • Delays caused by shipping lines, port authorities, or customs;
  • Errors in third-party documentation (e.g., bills of lading issued by carriers);
  • Misinterpretation of local import regulations by the Customer;
  • Acts of God, war, strikes, pandemics, or government actions.

Our total liability for any claim related to your order shall not exceed the total amount paid by you for that specific transaction.

9. Indemnification

You agree to indemnify, defend, and hold harmless CAR BUY CHINA, its officers, employees, and partners from any claims, losses, damages, or expenses (including legal fees) arising from:

  • Your breach of these Terms;
  • Your violation of any law or third-party rights;
  • Your misrepresentation of business status or import authority.

10. Third-Party Links and Services

Our website may contain links to third-party websites (e.g., shipping carriers, inspection agencies). These links are provided for convenience only. We do not endorse, control, or assume responsibility for the content, privacy policies, or practices of any third party.

11. Confidentiality and Business Communications

We may retain your contact and transaction data for legitimate business purposes, in accordance with our Privacy Policy.

12. Termination or Suspension

We reserve the right to suspend or terminate your access to our services at any time, with or without cause, if:

  • You violate these Terms;
  • You fail to meet payment obligations;
  • We detect suspicious or high-risk activity.

Termination does not relieve you of outstanding payment or indemnification obligations.

13. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the People’s Republic of China. Any dispute arising from or related to these Terms shall be subject to the exclusive jurisdiction of the competent courts in Guangdong Province, China.

Notwithstanding the above, nothing herein shall limit our right to pursue injunctive relief or enforcement in any jurisdiction where you operate or hold assets.

14. Amendments and Update

We may update these Terms at any time to reflect changes in law, policy, or business practice. The revised Terms will be posted on our website with an updated “Effective Date.” Your continued use of our services after such posting constitutes acceptance of the amended Terms.

It is your responsibility to review these Terms periodically.
